These are very challenging and unprecedented times and many businesses are suffering , It is natural to look for any help that is available and we fully support our clients with this.
Regrettably there has been a lot of confusion and misunderstanding regarding insurance and COVID 19 and the situation has been ever evolving.
The intention of Business Interruption cover is to respond following an insured event such as a Fire or Flood.
There is an extension under many policies which provides limited cover as a result of a premises being closed due to an outbreak of a notifiable infectious disease at that premises. In a lot of policies these diseases are listed and COVID 19 is not one of them as it was not known at the time.
Some policies include a condition that the outbreak must be at the premises ,or a similar wording to this, however this condition was challenged in the latest test case and we are waiting to hear if Insurers can no longer decline claims based on this condition alone.
There are some insurance policies where the wording is not clear and these have now been ruled upon in test cases. If you have suffered a loss and would like to explore the possibility of making a claim please do not hesitate to contact us.
